This is a useful Checklist that will help you determine whether the person is really an employee and not a contractor.

It sets out the elements that distinguish between employer/employee relationships and contractor relationships. You may think the relationship is a contractual relationship but as a matter of law it may well be an employer/employee relationship. This can have tax, superannuation, and workers compensation insurance ramifications.
